These Terms of Service ("Terms") govern your use of the services provided by 5280 Access ("we," "us," or "our"), including our website at 5280access.com, our AI-assisted phone support line at (510) 322-2377, our SMS follow-up messaging program, and our reorder and account portal (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

5280 Access provides AI-assisted technical guidance for commercial access control and security camera systems. The Service is intended for qualified building maintenance personnel, facility managers, and field technicians who are authorized to perform maintenance at their facility.

Eligibility

You must be at least 18 years old and authorized by the property owner or manager to request technical guidance for the systems you are calling about. By using the Service you represent that you meet these requirements.

Informational Only — No Professional Advice

All technical guidance provided through the Service is for informational purposes only. It is not a substitute for a licensed electrician, fire-life-safety contractor, low-voltage installer, or any other licensed professional. You are responsible for all work performed based on this guidance.

AI Disclosure

The voice and text responses you receive are generated by an artificial intelligence system trained on Jerry's 27 years of field experience. You are speaking with an AI, not a human. The AI may make mistakes, miss context, or give incomplete information. Use your professional judgment and verify critical steps independently.

Fees and Billing

The Service is currently offered free of charge during a development and testing period. We may introduce paid subscription tiers in the future, billed monthly to your facility or account. Pricing and terms for paid plans will be presented and accepted before any charges begin. Reorder purchases are billed at checkout.

Refunds

If you have a billing concern, contact us within 30 days of the charge. We review refund requests on a case-by-case basis. Shipped products are subject to a separate return policy provided at the time of purchase.

SMS Messaging Program

By opting in — verbally during a support call, by selecting the consent checkbox on our contact form, or by texting an opt-in keyword (START, SUBSCRIBE, JERRY, or SUPPORT) to (510) 322-2377 — you agree to receive text messages from 5280 Access related to your service request. Messages may include wiring diagrams, call summaries, follow-up confirmations, links to parts, and service reminders.

Message and data rates may apply. Message frequency varies. Reply HELP for help. Reply STOP to opt out at any time. Carriers are not liable for delayed or undelivered messages. For SMS support contact us at 5280@5280access.com.

Account Security

If you create an account or are issued a PIN to access your building's service history, you are responsible for keeping that credential confidential and for all activity that occurs under it. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that show signs of misuse.

Intellectual Property

All software, AI models, training data, voice models, written content, documentation, knowledge base entries, and trademarks associated with the Service are the property of 5280 Access or its licensors and are protected by U.S. and international intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service for your own facility maintenance purposes only.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5280 ACCESS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING WITHOUT LIMITATION DAMAGE TO EQUIPMENT, PROPERTY DAMAGE, FIRE, PERSONAL INJURY, OR LOSS OF BUILDING SECURITY — WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to defend, indemnify, and hold harmless 5280 Access and its affiliates from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your use of the Service, your violation of these Terms, your violation of any law, or your infringement of any third party right.

Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved by binding arbitration in Denver, Colorado, under the Commercial Arbitration Rules of the American Arbitration Association. Each party waives any right to a jury trial or to participate in a class action. Either party may seek injunctive relief in court for intellectual property or confidentiality issues.

Termination

We may suspend or terminate your access to the Service at any time for any reason, with or without notice, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.

Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Material changes will be announced on our website. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
